Terms and Conditions

 

1. General

 

These Terms and Conditions apply to all orders placed through fishqt.com. By placing an order with us, you agree to the terms set out below. fishqt.com is operated by MC Prime UG (haftungsbeschränkt), registered with the commercial register of the Amtsgericht Stuttgart under HRB 803477. The company is represented by its managing director, Navjot Kaur.

3. Conclusion of Contract

 

Displaying products on fishqt.com does not constitute a binding offer on our part but rather an invitation for you to place an order. By adding items to your cart and completing the checkout process, you submit a binding offer to purchase the selected products. We will confirm receipt of your order by email. This confirmation does not yet represent acceptance of your order. A binding contract is only formed once we send you a separate email confirming that your order has been shipped, or once the goods are delivered to you, whichever happens first.

 

We reserve the right to refuse an order, for example in cases of stock shortages, pricing errors, or suspected misuse.

 

4. Prices and Payment

 

All prices shown on fishqt.com are final prices and include statutory value added tax where applicable. Any shipping costs will be shown clearly during the checkout process before you complete your order. We accept the payment methods displayed at checkout. Payment is due at the time the order is placed unless otherwise agreed.

 

5. Shipping and Delivery

 

We currently ship exclusively within Germany. Orders are dispatched from either Germany or France, depending on stock availability and warehouse location.

 

We offer two shipping options:

 

Standard Shipping

This option is free of charge. Delivery typically takes between 4 and 5 business days from the date your order is dispatched.

 

Express Shipping

This option costs 4.95 EUR and includes shipment insurance. Delivery typically takes between 2 and 3 business days from the date your order is dispatched.

 

Delivery times are estimates and begin once your order has been handed over to the shipping carrier. Delivery times may vary due to circumstances outside our control, such as carrier delays or public holidays. We will inform you as soon as possible if we expect a significant delay in delivering your order.

 

Risk of loss or damage to the products passes to you once the products have been delivered to the address you provided at checkout.

 

6. Right of Withdrawal

 

As a consumer, you generally have the right to withdraw from your purchase within 14 days without giving any reason, in accordance with applicable consumer protection law. The withdrawal period begins on the day you, or a third party named by you who is not the carrier, take possession of the goods. To exercise your right of withdrawal, you must inform us of your decision by means of a clear statement, for example by email to info@fishqt.com. Further details regarding returns, refunds, and the condition in which goods should be returned will be provided separately on our website.

 

7. Warranty

 

We are liable for defects in the goods we sell in accordance with applicable statutory warranty provisions. If a product you receive is defective, please contact us at info@fishqt.com so that we can assist you.

 

8. Liability

 

We are liable without limitation for damages arising from injury to life, body, or health caused by us, and for damages caused by intentional or grossly negligent breach of duty on our part. For damages resulting from the breach of a material contractual obligation caused by ordinary negligence, our liability is limited to the damage that was foreseeable at the time the contract was concluded and typical for this type of contract. Any further liability is excluded, except as required by mandatory statutory provisions, including but not limited to product liability law.

 

9. Intellectual Property

 

All content published on fishqt.com, including but not limited to text, images, logos, and graphics, is the property of MC Prime UG (haftungsbeschränkt) or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or otherwise use this content without our prior written consent.

 

10. Changes to These Terms

 

We may update these Terms and Conditions from time to time to reflect changes in our business practices or applicable law. The version published on fishqt.com at the time you place an order will apply to that order.

 

11. Governing Law

 

These Terms and Conditions are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you are a resident, if more favorable to you, remain unaffected.
